Uninsured and Underinsured Motorist Coverage in California: The Protection Most Drivers Don’t Think About Until They Need It

You do everything right - you carry insurance, you drive carefully - and then someone slams into you who has no coverage at all, or nowhere near enough to cover your injuries. It happens far more often than most Californians realize. The single most valuable protection against that scenario is coverage you may already have and never think about: uninsured and underinsured motorist coverage, or UM/UIM.

Here is what it is, why it matters so much in California, and how to make sure you are not left paying for someone else's mistake.

What UM/UIM Coverage Actually Does

Uninsured motorist (UM) coverage steps in when the at-fault driver has no insurance. Underinsured motorist (UIM) coverage applies when the other driver has some insurance, but not enough to cover the full extent of your injuries. In both cases, your own policy fills the gap - paying for medical bills, lost income, and pain and suffering you would otherwise have to absorb yourself.

This is not a minor add-on. With a meaningful share of California drivers uninsured, and many more carrying only the state-minimum limits, UM/UIM is frequently the difference between a victim being made whole and being left with bills a negligent driver can never pay.

The California Detail That Catches People Off Guard

Under California law, insurers are required to offer UM/UIM coverage - but drivers are allowed to reject it in writing. Many people waive it without realizing what they are giving up, often to shave a few dollars off a premium. If you are not certain whether you carry it, now is the time to check your declarations page, not after a crash. A few additional dollars a month can be worth tens of thousands of dollars when it matters most.

One more nuance worth knowing: in a hit-and-run, California generally requires actual physical contact between the vehicles for an uninsured-motorist claim to apply - a reason, among many, to report every collision and preserve the evidence.

How These Claims Work - and Why They're Not "On Your Side" by Default

There is a common misconception that because you are claiming against your own insurer, the process will be friendly. In reality, a UM/UIM claim can be just as adversarial as any other - your insurance company is still evaluating how little it can reasonably pay. These claims also involve strict notice requirements and, often, binding arbitration rather than a court trial. Understanding the rules before you file protects the value of your claim.

If you were hit by an uninsured or underinsured driver in California, your own policy may hold more protection than you think - and your insurer will not always volunteer it. Pogosyan Law offers a free consultation to review your coverage and pursue every dollar available to you.
